1) Seller Confirmation Auction: This is an auction ordered by the owner, Eric William Foster. The property is being offered in an online only (internet) auction, with all bids being subject to the Seller’s approval.
2) Bidding Registration: Bidder hereby agrees that they must properly register for this auction by completing and signing this Auction Bidders Registration and Agreement and returning it to the auction company before placing bids online. The agreement can be scanned and emailed to the auction company at Auction@325SecondAve.com. The SELLER, at their sole discretion, may request additional registration requirements for individuals who are not known by the Seller or the auction company.
3) Bidding Opens/Closes: Bidding shall be opened (begins) and closed (ends) on the dates and times stated above.
4) Property Previews: Are available by contacting John Stein 970-318-0848 or Don Martin at 507-273-3525. It is recommended to all bidders to personally inspect the property prior to placing any bids in the auction. Property inspections are the sole responsibility of the bidders.
5) Cash Offer/No Financing Contingency: By participating in this auction, bidders hereby agree that their bid shall NOT be subject to the bidder’s ability to obtain financing. By placing a bid in this auction, bidders are making a “cash offer” to purchase the property. Financing is NOT a contingency in the purchase agreement.
6) As Is: Property is being sold in an “as is” condition with no contingencies and/or objections. A Blank Copy of the Contract to Purchase, a TBD Title Commitment, the Tax Certificate, and other Due Diligence Materials are available via email for review prior to the auction, upon signing this Bidder’s Agreement.
7) Buyer’s Premium: This is a Buyer’s Premium Auction. A Ten Percent (10%) Buyer’s Premium will be added to the final bid price, which will determine the Total Contract Sales Price. Bidders hereby understand that the Buyer’s Premium shall be added to the winning bid to create the Total Contract Sales Price for which they are obligated to pay for the property. Please keep this in mind when bidding.
8) Purchase Contract: Winning bidder hereby agrees to enter into a Contract to Purchase the property immediately upon being declared the Successful Bidder by the Auctioneer. Upon the close of the auction the winning bidder will be forwarded via email a Contract to Purchase the property. A signed copy of the Contract to Purchase must be received by Black Canyon Homes | Real or United Country Real Colorado Properties, Inc. no later than 24 hours from the time said Contract to Purchase was sent to the winning bidder. The Contract to Purchase may be hand delivered or e-signed/emailed.
9) Down Payment: A down payment of Fifteen Percent (15%) of the Total Contract Sales Price (Total Contract Sales Price includes the Buyer’s Premium) will be wire transferred or hand delivered in the form of certified funds to the Title Company along with the executed Contract to Purchase within timeframes outlined in the Contract to Purchase. 10) Closing: Closing will be on or before Friday, August 29th, 2025. Closing shall take place at Land Title Guarantee Company, 1561 Oxbow Drive, Suite 200, Montrose, CO 81401. (970) 249-9131. Out-of-state buyers will be afforded the opportunity to close via email, mail and wire transfer of certified funds.
11) Possession: Possession of the property will be given upon successful closing.
12) Title Insurance: Title Insurance in the full amount of the purchase price will be provided by the seller. Seller shall pay a prorated amount for 2025 real estate taxes.
13) Online Auction Technology Issues: Under no circumstances shall Bidder have any kind of claim against Black Canyon Homes | Real or United Country Real Colorado Properties, Inc., or anyone else if the Internet service fails to work correctly before or during the auction. Online bidding is subject to technological faults and issues which are outside the control of the auction company.
14) Registration of Buyer’s Broker: In the event that the Buyer/Bidder engages the services of a properly licensed Colorado Real Estate Broker (Buyer Broker/Agent) to represent them in this transaction and asks (per paragraph 29 of the Purchase Contract) for the Seller and/or Auction brokerage company to provide any compensation to the Buyer Broker/Agent, Buyer must verify that Buyer Broker/Agent has completed the Auction Cooperation Buyer Broker Compensation Agreement prior to signing this Auction Bidders Registration and Agreement. Otherwise, no outside compensation will be paid.
